What is a notice?
A notice is the legal concept in which a party is made aware of a legal process affecting their rights, obligations or duties. There are several types of notice: public notice (or legal notice), actual notice, constructive notice, and implied notice.

Characteristics of a good meeting

A successful meeting has four characteristics:

1.The meeting must have a clear purpose and should stick to the agenda
2.The meeting must start and end on time
3.Participants must be properly prepared
4.Minutes must be taken

Successful meetings:

Think about meetings you have attended. Were they successful? What makes a meeting successful? Write down the characteristics you think make for a successful meeting. If possible, discuss this topic with fellow students.

When dealing with formal meetings, there is a specific procedure to be followed:

1.Let everyone involved know that you are requesting a meeting for a particular reason, and give them the date, time and location for this. This is known as a Notice of Meeting and can take the form of a memo, letter, poster and/or email communication.

2.Before the meeting starts (sometimes given at the same time as the Notice of Meeting), you need to let all those invited to attend the meeting what it is that's to be discussed and the order that these items will be mentioned in. Known as an Agenda, this lets everyone prepare for the meeting in advance so that they can bring up any important points at the relevant time.

3.During the meeting itself, it is important that all points raised are noted so that a summary of the full meeting is recorded. These are the Minutes and they should show what was discussed, more especially what was agreed (or ruled out), and any action points - a note of something that has to be carried out, by whom, and usually with a deadline.

Networking Events: Organizing or sponsoring a networking event can be a great way to raise a company or individual’s profile within a certain community. Networking events can run from informal schmooze and booze affairs at a local bar to fully fledged galas complete with an open bar.

Party: A generic term for any social gathering.

Plenary or General Sessions: A large meeting open to all people attending an event. These sessions often kick off a large conference or convention before it begins.

Political Events: Political events are organized to raise awareness or funds for a particular candidate or cause. Democratic and Republican national conventions, the largest political events in the U.S. are organized to energize the base and bring in delegates from each of the 50 states. Press Conferences: Press conferences are often organized by newsmakers (most often in politics but also in business and in sports) to make an announcement or to field questions by press who happen to be invited to the conference.

Product Launch Events: Product Launches are often large scale events whose organizers invite journalists, bloggers and social media influencers to witness the very first unveiling of a company’s product. Receptions: In the meetings industry, receptions refer to a social function where light refreshments are served, usually buffet style. Receptions are often informal, and attendees will usually stand up and socialize rather than sit down at a table. Meetings are an important organisational tool as they can be used to:

Components of Meetings

A meeting can be divided into the following three main components:

Content is the knowledge, information, experience, expertise, opinions, ideas, attitudes and expectations that each individual brings to a meeting.
Interaction is the way in which the participants work together to deal with the content of a meeting. This includes the feelings, attitudes and expectations of the participants which have a direct bearing on co-operation, listening, participation and trust.
Structure is the way in which both the information and the participants are organised to achieve the purpose/objectives of the meeting.

Types of Meetings

There are many different types of meetings; here we focus on those used to:

Informing Meetings

These are the most straightforward meetings where one member, usually the chairperson, has factual information or a decision which affects all those present, which he/she wishes to communicate. Such meetings tend to be formal as their aims are to give the members a real understanding and to discuss any implications or how to put such information to best use.

Consulting Meetings

These are meetings used to discuss a specific policy or innovation and can be used to get participants' views of such a policy or idea. An example could be:

Review a current policy
State its deficiencies
Suggest change
Stress the advantages of such change
Admit any weaknesses
Invite comments
Problem Solving Meetings

These meetings are dependent upon the chairperson describing the problem as clearly as possible. Members should be selected according to their experience, expertise or interest and then given as much information as possible to enable them to generate ideas, offer advice and reach conclusions. Decision Making Meetings

These types of meetings tend to follow an established method of procedure:

Many organisations hold regular meetings to enable members to report and discuss progress and work in hand, to deliberate current and future planning. Such meetings can contain elements of each of the four above examples.

Planning and Preparation for a Meeting

Of prime importance for the success of any meeting is the attitude and leadership of the chairperson. In a meeting, the chairperson is the leader and, as such, has to perform the same function as the leader of any working group.

For a meeting to be effective, the chairperson has to:

Plan, organise and control the discussion of subjects on the agenda.
Maintain the group by encouraging and developing harmonious relationships.
Motivate the individuals by encouraging all to contribute, rewarding their efforts and supporting them in any difficulties.
Before any meeting, the chairperson should ask and resolve the following questions:

What is the purpose of the meeting?
Is a meeting appropriate?
How should the meeting be planned?
Who should attend the meeting?
What preparation is required for the meeting?

All meetings must have a purpose or aim and the chairperson must ask questions, questions as:

What is to be achieved by this meeting?
Is advice required on a particular issue?
Has a problem arisen that needs prompt discussion?
Is this a regular meeting to keep members 'in touch'?
Is a Meeting Appropriate?

The chairperson should always consider whether a meeting is necessary or if some other means of communication is more appropriate,for example memos or emails targeted to individuals inviting comment. Unnecessary meetings may waste time, lead to frustration and negativity and may lower motivation to participate in future meetings.

How Should the Meeting be Planned?
This will very much depend on the type of meeting to be held. There should be some rationale behind every meeting, no matter how low-level or informal, and this will largely dictate the content and indicate how planning should proceed.

Who Will Attend the Meeting?
This is often decided by the nature of the meeting itself. In a small organisation, a meeting could well include all members of staff, whereas a working party or committee meeting will already have its members pre-determined. In a large organisation or department, staff attending might well be representing others. It is important that the full implications of such representation are realised by the individuals concerned as they are not merely speaking for themselves. Meetings outside the workplace may include members of the board of directors or other interested parties.

What Preparations are Needed for the Meeting?
If maximum contribution is to be forthcoming from all participants, the purpose of the meeting should be recognised by all. The most tangible expression of this is the agenda which should be circulated beforehand to all those invited to the meeting. The agenda should:

Give the time and place of the meeting.
List the topics to be covered, indicating who will introduce them.
Have any relevant papers attached.
Give the time the meeting will close.
The Agenda: This is the outline plan for the meeting. In most formal meetings it is drawn up by the secretary in consultation with the chairperson. The secretary must circulate the agenda well in advance of the meeting, including any accompanying papers. The secretary also requests items for inclusions in the agenda.

Regular meetings often start with the minutes from the last meeting followed by 'matters arising' which forms a link with what has happened in the previous meeting. Most meetings conclude with 'any other business' (AOB) which gives everyone the opportunity for any genuine last minute items to be raised; though more formal meetings may have AOB items listed on the agenda.

On February 7, 2014, at 2PM, it will be impossible to complete all the adjudication process or trial within a few minutes or hours.

It has been mentioned vividly in the submission of January 9, 2014, that I can walk into court during that specific time period, but I cannot reach the court at a specific time and date – for example February 7, 2014, at 2PM – due to the reasons mentioned.

Moreover, the attorney for the Mercy Housing management group did not meet with me even though I asked them to understand the harms to me properly before asking the court to issue a summons.

What Is the Difference Between a Summons and a Subpoena?
A subpoena and a summons are similar because they both give notice to someone about a court proceeding. Some differences between a subpoena and a summons include:
    who they are given to
    when they are given
    what they are used for
What is a summons?
A summons is an official notice of a lawsuit. It is given to the person getting being sued, the defendant. If you sue someone, they need to be told about it so they can come to court and prepare to defend themselves. When you serve the defendant with a summons, you officially tell that you are suing them. You must follow the rules for giving the summons to the defendants to properly file your case. For helpful videos on filing court papers, see the Law Basics Video Series.

What is a subpoena?
A subpoena is a court order. It requires someone to come to court, go to a deposition, or give documents or evidence to you. In a deposition, someone answers questions about a legal case, under oath. If you need a witness to come to court or give a deposition, you can serve them with a subpoena. You can also use a subpoena to get evidence from a person not involved in the lawsuit. You can also use a subpoena to get documents from a _______.

How do I send a summons?
If you sue someone, you must serve them with a summons. This gives them notice of the lawsuit. “Service of process” is the formal name for giving a defendant a summons to come to court. Each defendant must get individual service. You cannot serve the defendant yourself. You must serve a summons in one of three ways:
    Service by the Sheriff
    Service by a Private Process Server
    Service by Certified Mail (only available in certain cases)
Service by the Sheriff

Service by the Sheriff is the easiest way to serve your summons. You will have to pay the Sheriff a fee unless you have a court order that says you do not have to. To see if you qualify, read Filing Court Papers for Free or watch our video Filing Court Papers for Free.

If you want the Sheriff to serve your summons, take the summons to the Sheriff. You will need one original and two copies, with the complaint attached to each one. The Sheriff will give the summons to the defendant by hand. They can also give it to someone who lives with the defendant who is at least 13 years old. Next, the Sheriff fills out a sworn statement on the back of the copy of the summons. Then, they file it with the Clerk of the Court. The Court must have a record that the Sheriff served the summons.

Service by a Private Process Server

If the Sheriff cannot serve the defendant, you may want to try a private process server. The Sheriff only needs to try service once, and the defendant might not be home at the time. A private process server will try to serve your summons more than once.

You need to ask the court to let you use a private process server. To do this, you must file an “Ex-Parte Motion for Appointment of Special Process Server.” A private process server must be at least 18 years old and cannot be involved in the lawsuit. The private process server can serve the defendant only after the judge approves them. After they serve the summons, the private process server fills out an affidavit. They should sign it, notarize it, and attach it to the original summons. The Court must have a record server give the summons to the defendant.

Corporations and partnerships get service in a different way. Usually an agent accepts service for the corporation. Sometimes an officer of the corporation will accept service. Service by Certified Mail

Some cases allow service by certified mail, such as a small claims case. You do not need to have someone else serve the defendants. You may deliver the summons and a copy of the complaint by certified mail. It should be restricted delivery, return receipt requested. Restricted delivery means that only the person you addressed the summons to can sign for it. A Return receipt is a green postcard that shows that the post office delivered the letter. Make sure you keep a record of when you sent the letter and to whom. Also, keep the green return receipt when you get it in the mail. It will prove to the court that you served the defendant.

How do I send out a subpoena?
Sometimes, a witness will not testify in court willingly. You can subpoena the witness, which requires them to come to court. You can also use a subpoena during discovery. Discovery happens before trial. It lets both sides find information and evidence to prepare for their case. During discovery, you can subpoena a person to come to a deposition and answer questions. You can also get evidence from a person or ________ who is not a party in the lawsuit.

To subpoena a witness, you can get the form in the clerk’s office. Fill in the name of the case, the name and address of the witness, and the courtroom for the case. When you subpoena a witness, you must pay them a witness fee and travel costs. The clerk can help you figure out the amount. Fill out the subpoena and make out a check or money order to the witness. Then, you or any other adult may give the subpoena and payment to the witness. You can give the subpoena in person or by certified mail. Mail should be restricted delivery, return receipt requested. Make sure you keep a record of the delivery. You must be able to show that you gave the witness the subpoena. You may also ask the sheriff's office to deliver the subpoena and check to your witness.

During discovery, you can also get the subpoena form in the clerk’s office in your courtroom. For a deposition, fill in the name of the case and the name and address of the witness. Also, fill in the place, time and date of the deposition. If you want documents, you must list what kind of documents you want in the subpoena. Once you fill out the form, you or any other adult may give the subpoena to the witness. You can give the subpoena in person or by certified mail. Mail should be restricted delivery, return receipt requested. Make sure you keep a record of the delivery. You must be able to show that you gave the witness the subpoena. You may also ask the Sheriff’s Office to deliver the subpoena.

Can I ignore the subpoena or summons?
You should not ignore either a subpoena or a summons. You should talk to a lawyer if you get either one.

A summons is an invitation to come to court. It is not an order so you do not have to do what it says. But, if you ignore a summons, you will likely lose the case against you. The court will usually decide the lawsuit in favor of the person suing you. The court could decide that you have to pay money or that you must stop doing something. You will have to obey the court’s final decision even though you did not take part in the lawsuit.

There is one kind of summons that you cannot ignore. You cannot ignore a Citation to Discover Assets. If you lose a case and owe someone money, but do not pay it, you could get a Citation to Discover Assets. If you get a Citation to Discover Assets, you should talk to a lawyer right away. You should not ignore the Citation or fail to appear on the court date. If you do, you could face penalties.

You cannot ignore a subpoena. A subpoena is a court order to come to court. If you ignore the order, the court will hold you in contempt. You could go to jail or face a large fine for ignoring the subpoena. Subpoenas are used in both criminal and civil cases. They can be given to anyone that might have helpful information about the case. This can be testimony or documents and evidence. If you get a subpoena and do not want to testify or turn over documents, do not just ignore it. Ask a lawyer to help you figure out what to do.

What if the summons was not properly served?
If the other party serves you improperly, go to court on the date stated in the summons and tell the judge. The judge should not let the case against you go on if service was improper. The judge will probably not throw out the case against you. Instead, they will probably let the plaintiff try to serve you again. If the plaintiff properly serves you on the second try, the lawsuit may not be over.

If someone serves you a subpoena, do not ignore it. It does not matter if service was proper or not. If you know about the subpoena then you should follow the orders in it. If you think service was incorrect, you should talk to a lawyer right away about your options and rights.
