Licenses Q. To whom should I complain in case I am not granted the license applied for to deal in the above essential commodities? A. Am I allowed to transfer my above licenses, and if so, under what conditions? A. Transfer of license is not allowed. However, change in the constitution of the firms/companies may be allowed, under specified circumstances. Q. In what form and how frequently should a license submit statements to the Department? A. How to locate the FPS/Kerosene Oil Depot at which my consumer card has to be registered? A. The number of FPS/KOD is mentioned on your household consumer card. While obtaining your consumer card , you should ask for address of the FPS/KOD where your card is linked from the Circle Office. Q. What to do if I want to draw my supplies from a FPS/KOD located nearer to my dwelling unit? A. You may apply to Circle Office on form no. to get your card registered with the nearer FPS/KOD. Q. Can I draw specified articles from the FPS in respect of a member of family included in the household consumer card who has been away for some time ? A. Household consumer card is available for lawful use for the persons included therein who are actually residing at the given address at the time of drawing supplies. In case of absence from the household for a period exceeding one month of any person included in the household consumer card, the holder of the HCC shall give prompt intimation to the FSO of the Circle in which he is residing and shall present his household consumer card for deletion of name of such person in case he is likely to be away for quite some time. Q. Am I entitled to sugar in case some of the co-resident included in my household consumer card are filing returns and are assessed to income tax, though, none is paying income tax ? A. Sugar is issued on household consumer card where none of the persons included in the household consumer card is an income tax assessee. In this case, sugar can not be issued on your HCC even if none of the persons included therein is an actual income tax payee, as some of them are assessed to income tax. Q. How do I know the rates fixed by the government for different articles being sold at the FPS/KOD? A. Prices of all articles sold through FPS and KOD as fixed by the government are displayed at the notice board of the shop. Q. Can I draw supplies to which I am entitled but which have not been drawn during the relevant period, in a subsequent period? A. No. Q. How can I help in smooth running of the public distribution system? A. * You should not alter any entry in the HCC. * You should not transfer your HCC for use by any other person. * You should not draw any specified articles from fair price shop in respect of a person included in your HCC who is not living in the UT of Delhi at the time such supplies are obtained. * Present your HCC to the area FSO for deletion of name of a person included in your HCC who is away from the UT of Delhi for more than a month. * If you and your family is leaving Delhi permanently deposit your HCC in the Circle Office. * In case you shift your place of residence, you should report such change to your Circle who will make the necessary endorsement on your card, if you are shifting within a Circle; or give you a surrender certificate to get a new HCC made at the new place of residence, if you are shifting out of the jurisdiction of the Circle. * Any subsequent change in the status of any parameter on which the card was issued e.g. addition, deletion of family members, change in entitlement of specified articles resulting from change in age of family members, assessment of any member to income tax, getting a LPG connection in the name of any person included in the HCC, etc. should be reported immediately to the Circle Office. Ration Card Q. I need a ration card. Can I be issued one ? A. Any person permanently residing or intending so to do in the National Capital Territory of Delhi (NCTD) who desires to have a Household Consumer Card (HCC), commonly referred to as Permanent Ration Card (PRC), can be issued one if he, or some other person on his behalf, is not already in possession of such a card, or if name of any member of his family is not included in another HCC. Q. Can a person who is residing with me and whose particulars are recorded in the PRC issued to me be issued a separate HCC on the same dwelling unit? A. Household means a family unit living together in one building or portion of the building held in possession of any member of the family as resident and maintaining a common kitchen and includes person so living together, whether or not dependent on the holder of the HCC. Accordingly, a person living with you can get a separate consumer card only if he establishes that he has a separate kitchen. Q. I am visiting Delhi but don’t intend to stay here for long. Can I get a ration card? A. A household Consumer Card is available for lawful use only for the person or persons who reside, or intend to reside, permanently in the NCT of Delhi. A person can be deemed to be permanently residing in the NCT of Delhi for purpose of issue of supplies from public distribution system if he is ordinarily living in NCT of Delhi and is not absent there from for a period exceeding one month at a time. A person or class of persons who do not reside, or intend to reside, permanently in the National Capital Territory of Delhi can, however, be issued "special permits" for obtaining supply of any of the specified articles for such period, for such quantity and from such source as may be specified therein. Q. I am staying in a residential college (hostel)/working women hostel with mess facility. Do I need to obtain Household Consumer Card? A. Inmates of these institutions are not required to obtain individual Household Consumer Cards. ‘Establishment Permits’ are issued to institutions such as Hostels/Hospitals/Welfare Homes etc. Q. I belong to armed forces and get ration from canteen. Can I be issued a household consumer card? A. If a person is receiving specified articles for himself or members of his family from any Naval/Military/Airforce Authority, he will not be issued Household Consumer Card. However, such service personnel as are on leave and residing in the National Capital Territory of Delhi and not drawing specified articles from Naval/Military/Airforce authority will be entitled to obtain Household Consumer Card for the specified period of leave. Q. Can a consumer card be issued to my servant who is residing with us? A. You may apply for inclusion of your servant’s name in your consumer card, preferably after getting his police verification. Q. I am a new resident in jhuggi cluster. Can I be issued a household consumer card ? A. The Government invites applications for preparation of jhuggi ration cards from time to time. At present, no such scheme is in operation. You may apply as a when applications for the purpose are invited by the Government. Q. Though I am a user of LPG, my servant and driver included in the household consumer card cook separately using kerosene oil. Can a blue card be issued to me ? A. No, a blue card cannot be issued to you. However, your servant and driver can be issued a separate HCC. Q. Do I have to make different household consumer cards for different commodities ? Ans. For all specified articles sold through public distribution system (PDS), only one consumer card is required. Q. What to do in case I do not know any gazetted officer or other competent authority for having my photograph attested for getting a ration card? A. You can get it attested by elected representative of your area such as MLP, MP or Municipal Councillor. Q. What to do if my landlord is not giving me any rent receipt or NOC indicating my residence? A. Witness of two neighbours or any other proof of continuous residence may be submitted. Q. What to do in case I do not have any evidence of surrender of my previous consumer card ? Ans. In such cases, an affidavit attested by the area SDM/Oath Commissioner/Notary Public may be submitted. Consumer Affairs Q.Is there any prescribed proforma for filing complaint in a District Fora? A. A complaint on a plain paper, either handwritten or typed, can be filed in consumer fora. Q.Is any court fee is needed for filing a complaint? A. No, there is no need of any stamp or court fee under Consumer Protection (Amendment) Act 2002. Q. Is there any need for a registered lawyer for filing a complaint.? A. No, there is no need of lawyer for filing a complaint. Q. Who is Consumer? A. Under Consumer Protection Act 1986 a consumer is any person who buys any goods for a consideration, and user of such goods where the use is with the approval of a buyer. Any person who hires/avails of any service for a consideration and any beneficiary of such services where such services are availed of with the approval of the person hiring the services is also a consumer. The consumer need not have made full payment. Q. What is meant by "goods" and ‘services"? A. Goods mean any movable property and also include shares, but do not include any actionable claims. Service of any description is covered under Consumer Protection Act and includes banking, financing, insurance, transport, processing, housing, construction, supply of electrical energy, entertainment, amusement, board and lodging among others, but does not include rendering of any service free of charge or under a contract of personal service. Q. How long do consumer forum take to finalize a complaint? A. Generally, complaint should be decided within 90 days from the date of notice issued to the opposite party. Where a sample of any goods is required to be tested, a complaint is required to be disposed of within 150 days. Q. What are the penalties for non-compliance of order of consumer forum? A. Where a trader or a person against whom a complaint is made (or the complainant) fails or omits to comply with any order made by the District Forum, the State Commission or the National Commission, as the case may be, such trader or person shall be punishable with imprisonment for a term which shall not be less than one month but which may extend to three years or with fine which may not be less than two thousands rupees but may extend to ten thousands rupees, or with both. Weight and measures Q. How can I tell whether a weight used by a shopkeeper is correct or not? A. Every user of weights, measures, weighing machines in course of trade or production is required to get verified such weighing and measuring units periodically from weights & measures department. As shown in the adjoining picture, the verification stamp mark on the bottom of the weight shows the quarter and year of verification on the lead seal, for example A-stands for 1st quarter, B- for second, C-for third etc. of a calendar year. The last two digits of the year are also stamped on the seal. The periodicity of verification of weighing and measuring unit is prescribed as follows:- * two years for cast iron weights/brass weights, * one year for all other categories of weights, measures and weighing and measuring machines. Consumers may check the valid stamp on cast iron/brass weights, electronic weighing machines, steel meters for measuring cloth, petrol dispensing units, counter scales, milk and kerosene oil measuring vessels, TSR/Taxi fare meters and any other measuring instrument being used for commercial purposes, before purchasing any item or hiring services. Q. What precaution should a consumer take at the time of making purchases of items of daily consumption e.g. vegetables, fruits, groceries, sweets etc.? A. Please ensure that the weights & weighing machines used by the seller have been verified by, and bear valid stamp of the Weights & Measures Deptt. In case of Electronic Weighing Machine, please see the "zero" reading before weighment of the item being purchased to ensure the needle points to ‘zero’ marking on the display panel when no weight is used. The seller should not use weights like coins, stones and woodpiles Q. What is the time schedule for disposal of various categories of cases regarding weights & measures ? A. The Department is going to start the process of renewal of existing ration cards of General Category (Above Poverty Line) . The renewal will be done in phases starting with the New Delhi Zone The consumers can obtain the application forms from the Fair Price Shops and concerned Circle Offices on payment of Re.1/-, the application forms can also be submitted through the Delhi Govt. website from the address www.delhigovt.nic.in/dept/food/fpds1.asp.
