In terms of proof, an employee who has been provoked must prove:
(a) that the provocation was wrongful; and
(b) that such conduct would have induced a reasonable person to ‘lose control’.
Thus, instead of dismissal, the employee may be issued with a final written warning.
What is Bullying?
It is mistreatment severe enough to compromise a targeted worker's health, jeopardize her or his job and career, and strain relationships with friends and family. It is a laser-focused, systematic campaign of interpersonal destruction. It has nothing to do with work itself.
